This is an action for damages for wrongful discharge. The issue is whether defendants are immune from liability under ORS 30.265(3)(a). The trial court granted summary judgment to defendants. The Court of Appeals reversed. Moustachetti v. State of Oregon, 122 Or.App. 598, 858 P.2d 487 (1993). For the reasons that follow, we affirm the decision of the Court of Appeals on different grounds.
